This legal notice outlines the general conditions governing access and use of this website, hereinafter “the website.” The use of the website implies the express and full acceptance of these general conditions in the version published at the time the user accesses it, without prejudice to any specific conditions that may apply to certain services of the website.

Driphealth, S.L owns or is licensed to all intellectual and industrial property rights to its website and the elements contained therein. Therefore, the reproduction, distribution, public communication, and transformation of all or part of the contents of this website for commercial purposes, in any format and by any technical means, without the authorization of the Terms and Conditions, is expressly prohibited.

The trademarks, trade names, or distinctive signs are the property of Driphealth, S.L, whether by industrial or intellectual property rights, without it being understood that access to the portal grants any rights over the aforementioned trademarks, trade names, and/or distinctive signs.

All products and services on these pages that are NOT owned by Driphealth, S.L are registered trademarks of their respective owners and are recognized as such by our company. They only appear on Driphealth, S.L website for promotional and informational purposes. These owners may request the modification or removal of the information that belongs to them.

 

  1. Portal Usage Conditions

3.1 General

The User agrees to use the portal correctly in accordance with the law and this Legal Notice. The User shall be liable to Driphealth, S.L or third parties for any damages that may result from non-compliance with this obligation.

The use of the portal for purposes harmful to the property or interests of Driphealth, S.L or third parties, or in any way that overloads, damages, or disables the networks, servers, and other computer equipment (hardware) or products and applications (software) of Driphealth, S.L or third parties, is expressly prohibited.

3.2 Content

The User undertakes to use the contents in accordance with the law and this Legal Notice, as well as with any other conditions, regulations, and instructions that may apply as per Clause 1.

By way of example, and not as a limitation, the User must refrain from:

  • Reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the contents unless authorized by law or expressly consented to by Driphealth, S.L or the holder of the exploitation rights, where applicable.

  • Reproduce or copy for private use the Contents that may be considered as Software or Database in accordance with current legislation on intellectual property, as well as their public communication or making them available to third parties when these acts necessarily imply reproduction by the User or a third party.

  • Extracting and/or reusing all or a substantial part of the portal’s contents and the databases made available by Driphealth, S.L.

3.3 Introduction of Links to the Portal

Internet users who wish to introduce links from their own websites to the portal must comply with the following conditions, without knowledge of these conditions exempting them from legal liability:

  • The link may only connect to the home page of the portal and may not reproduce it in any way.

  • It is prohibited to establish frames or any other mechanisms that enclose the portal or allow the display of its contents through URLs other than those of the portal, potentially causing user confusion about the origin of the service.

  • The page that establishes the link must comply faithfully with the law and may not under any circumstances provide or link to its own or third-party content that: (I) is unlawful, harmful or contrary to morals and good customs (pornographic, violent, racist, etc.); (II) induces or could induce the User to the false conception that Driphealth, S.L. subscribes to, endorses, adheres to or in any way supports the ideas, statements or expressions, whether lawful or unlawful, of the sender; (III) are inappropriate or irrelevant to the activity of Driphealth, S.L. in view of the place, content and subject matter of the sender’s website.

 

  1. Exclusion of Liability

4.1 Information

Driphealth, S.L is not responsible for decisions made based on the information provided in the portal nor for damages to the User or third parties arising from actions taken solely on the information obtained from the portal.

4.2 Service Quality

Access to the portal does not imply an obligation on Driphealth, S.L to ensure the absence of viruses or harmful elements. It is the User’s responsibility to use the appropriate tools for detecting and disinfecting harmful computer programs.

Driphealth, S.L is not responsible for any damage to the User’s or third parties’ computer equipment during the use of the portal service.

 

4.3 Service Availability

Access to the portal requires third-party services, including telecommunications networks, whose reliability, quality, and functioning are beyond the control of Driphealth, S.L. Consequently, services provided through the portal may be suspended, canceled, or become inaccessible without prior notice

Driphealth, S.L. shall not be liable for damages of any kind caused to the User as a result of failures or disconnections in the telecommunications networks that lead to the suspension, cancellation or interruption of the Portal service during or prior to the provision of the same.

 

4.4 Content and services linked through the Portal

The Portal access service includes technical linking devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter, ‘Linked Sites’). In these cases, Driphealth, S.L. acts as an intermediary service provider in accordance with Article 17 of Law 34/2002 of 12 July 2002 on Information Society Services and Electronic Commerce (LSSI) and shall only be liable for the content and services provided on the Linked Sites to the extent that it has actual knowledge of the unlawfulness and has not deactivated the link with due diligence. In the event that the User considers that there is a Linked Site with unlawful or inappropriate content, he/she may notify Driphealth, S.L. in accordance with the procedure and effects established in clause 6, without this notification in any case entailing the obligation to remove the corresponding link.

Under no circumstances shall the existence of Linked Sites presuppose the existence of agreements with the managers or owners thereof, nor the recommendation, promotion or identification of Driphealth, S.L. with the statements, content or services provided.

Driphealth, S.L. has no knowledge of the content and services of the Linked Sites and therefore accepts no liability for any damage caused by the unlawfulness, quality, failure to update, unavailability, error and uselessness of the content and/or services of the Linked Sites or for any other damage which is not directly attributable to Driphealth, S.L.

  1. Reporting of activities of an illegal and inappropriate nature

In the event that the User or any other Internet user becomes aware that the Linked Sites refer to pages whose content or services are unlawful, harmful, denigrating, violent or contrary to morality, he/she may contact Driphealth, S.L. indicating the following:

  1. Personal details of the caller: name, address, telephone number and e-mail address;
  2. Description of the facts that reveal the unlawful or inappropriate nature of the Linked Site;
  3. In the event of violation of rights, such as intellectual and industrial property, the personal details of the holder of the infringed right when this is a person other than the communicating party.
  4. You must also provide the title accrediting the legitimacy of the holder of the rights and, where appropriate, the title of representation to act on behalf of the holder when it is a person other than the communicating party;
  5. Express declaration that the information contained in the complaint is accurate.

Receipt by Driphealth, S.L. of the communication provided for in this clause shall not imply, in accordance with the provisions of the LSSI, actual knowledge of the activities and/or contents indicated by the communicating party.

You must also provide the title accrediting the legitimacy of the holder of the rights and, where appropriate, that of representation to act on behalf of the holder when it is a person other than the caller.

  1. Notifications

All notifications and communications made by the parties shall be valid in accordance with the means permitted by law. Those relating to this Portal shall be considered effective, for all purposes, if they are made through the Portal itself.

 

  1. Modifications

Driphealth, S.L. reserves the right to make any changes it deems appropriate to its website without prior notice, and may change, delete or add content and services provided through the website and the way in which they are presented.

On the other hand, these terms and conditions may change at any time. The modifications will come into force from the moment of their publication.
